1. Acceptance and Capacity

By accessing or using Shield My Field (the "Platform"), you accept these Terms and Conditions in their entirety. If you disagree, do not use the Platform. You represent under oath that you are 18 years of age or older and have legal capacity to bind yourself. If acting on behalf of a legal entity, you represent having sufficient authority to bind it.

2. Nature of the Service

Shield My Field is an information platform that aggregates public data about real estate developers in the Yucatan Peninsula, Quintana Roo, and Baja California Sur, and publishes an evaluation system called Trust Score. It also offers a knowledge center, a verified-buyer review system, and, for Pro subscribers, custom due diligence reports.

Shield My Field is NOT: (i) a financial or investment advisor, (ii) a real estate agent or broker, (iii) a financial institution or rating agency, (iv) a law firm (PeninsuLawyers is a separate legal entity that may be independently retained for individualized advice), (v) a guarantor of any developer's or project's future performance.

3. Trust Score — Nature, Scope, and Disclaimer

3.1 Nature

The Trust Score is an algorithmic rating from 0 to 100 that classifies developers into four bands (Reliable, Acceptable, Caution, High Risk) based on public information aggregated at the time of calculation. The methodology is fully and auditably published at /metodologia.

3.2 Express Limitations

  • The Trust Score is informational and does not constitute a purchase or investment recommendation, nor an expert opinion.
  • It relies on public data that may contain inaccuracies, omissions, delays, or source errors.
  • A high rating does not guarantee delivery or future performance.
  • A low rating does not imply unlawful conduct; it reflects objective risk indicators on a specific date.
  • The score may change at any time as new data is incorporated. No user or developer acquires a contractual right to a specific score.

3.3 User Decisions

Purchase, investment, or contracting decisions are the user's sole responsibility. We strongly recommend: (i) consulting an independent attorney, (ii) conducting direct due diligence, (iii) verifying permits with the relevant authority, (iv) physically inspecting the property and original documentation.

4. User Account

  • You are responsible for maintaining confidentiality of your password and all activity under your account.
  • Sharing credentials, creating multiple accounts to evade limits, or using false identities is prohibited.
  • Notify us immediately at legal@shieldmyfield.com upon unauthorized account use.
  • We may suspend or cancel the account for breach of these Terms, fraud, or legal requirement.

5. Memberships, Subscriptions, and Payments

5.1 Plans

We offer a free plan (Basic) and paid plans (Premium, Pro) with prices in Mexican Pesos (MXN). Current prices and features are published at /membresias. Taxes apply where relevant.

5.2 Auto-renewal and right to cancel

Paid plans auto-renew at the end of each cycle (monthly or annual), charging the registered payment method. You may cancel renewal anytime from your account without penalty; you retain access through the end of the already-paid period. Pursuant to article 56 of Mexico's Consumer Protection Law, we will email you a reminder at least 7 calendar days before each annual renewal.

5.3 Price changes

Any price change will be notified at least 30 calendar days before renewal; you may cancel before renewal to avoid the new price.

5.4 Refunds

Pursuant to LFPC, we evaluate refund requests case by case. General rule:

  • Full refund within 7 calendar days of the first charge of each paid plan if the service has not been materially used.
  • Pro-rata refund in case of improper charge or material failure attributable to the Platform.
  • Already-elapsed periods are not refunded merely upon cancellation.

5.5 Free trial

The 7-day Premium trial does not require a card and does not auto-renew. After the period, the account returns to Basic unless the user actively contracts a paid plan.

6. User-Generated Content (Reviews)

6.1 Author responsibility

Reviews, ratings, and comments are the sole responsibility of the author. By posting, you represent under oath that the content is truthful, your own, or that you have authorization to use it, and you grant Shield My Field a non-exclusive, worldwide, royalty-free, term-of-protection license to reproduce, display, translate, and archive it within the service.

6.2 Verification

Some reviews require proof of purchase(payment receipt, contract, notarized receipt) to be tagged as "verified buyer". Unverified reviews may carry less weight in aggregate calculations.

6.3 Moderation

We remove or restrict content that:

  • Is false, defamatory, slanderous, or insulting (including attribution of crimes without final judgment)
  • Violates third-party intellectual property or privacy rights
  • Includes hate speech, threats, harassment, third-party sensitive data, or non-consented PII
  • Is spam, undisclosed advertising, or coordinated manipulation
  • Harms minors or is unlawful

6.4 Challenge procedure

If you believe a review is improper, write to legal@shieldmyfield.com including URL, reason, and supporting documentation. We resolve within a reasonable timeframe, in any case less than 30 calendar days.

7. Developers' Right of Reply

Developers included on the Platform have a right of reply via verified profile claim:

  1. Request claim from the profile page providing identity verification data (RFC, official website, verified social media).
  2. Once ownership is verified by our team within a target 48 business-hour timeframe, they gain access to the response portal.
  3. They may publish an official reply alongside reviews and provide documentation that rectifies demonstrably incorrect public data.
  4. They may request rectification of factual information based on official documentation; we resolve per applicable law.

Inclusion on the Platform is free and verified profile ownership does not condition the rating. Identity verification does not imply commercial sponsorship or editorial approval.

7-bis. B2B Developer Services

Developers with an approved profile claim may purchase three optional, complementary services:

  1. "Verified Developer" subscription (5,000 MXN/month or 49,990 MXN/year): unlocks the portal to reply to reviews and irregularity flags, edit public profile information, and order the additional services. Cancelable at any time via the Stripe portal; cancellation takes effect at the end of the paid period.
  2. Lawyer audit (one-off 29,999 MXN): PeninsuLawyers reviews incorporation documents, active permits, and PROFECO compliance with a target SLA of 30 calendar days from full evidence submission. Approval grants the "Lawyer-audited"badge on the public profile. The audit verifies document authenticity — it does NOT guarantee project quality, delivery timelines, or investment results. Badge validity holds until material changes occur at the company or its projects, at which point a re-audit may be required.
  3. Sponsored slot (14,990 MXN per state per calendar month): the developer appears as a highlighted card on the homepage and on search results filtered by the selected state during the paid month, always with the visible "Sponsored" label. A maximum of one active sponsored slot per state per month is allowed. The sponsored slot is advertising and does not constitute an editorial recommendation. The Trust Score is not affected by any payment.

B2B services are independent from each other, are not a condition for inclusion on the Platform, and do not modify the public Trust Score methodology, which is computed solely from public, verified sources as described in our Methodology.

7-ter. Brokers and Property Listings

Brokers and agencies with an approved claim may purchase a membership (Starter or Pro) to publish third-party property listings on the Platform, plus featured listing and broker verification add-ons. With respect to these services the user acknowledges that:

  • Listed properties are third-party inventory. Shield My Field does not verify, validate, or guarantee individual listings, their price, availability, ownership, or any information published by the broker.
  • Brokers are excluded from the Trust Score and developer rankings; a listing neither receives nor conveys a trust rating.
  • The "Featured" listing is paid advertising and does not constitute a recommendation or endorsement of the property or the broker.
  • When a listing is linked to an assessed development, the Trust Score shown belongs to the project's developer, not to the property or the broker.
  • The "Verified Broker" badge is granted only after PeninsuLawyers review and implies no guarantee over individual transactions.

8. Prohibited Conduct

The following is expressly prohibited:

  • Using the Platform for unlawful, fraudulent, or bad-faith purposes
  • Automated scraping, reverse engineering, decompilation, or mass data extraction without written authorization
  • Circumventing technical protection, authentication, rate-limiting, or membership gating measures
  • Impersonating individuals, developers, or authorities
  • Posting defamatory, slanderous content, or content that constitutes unfair competition
  • Selling, sublicensing, or redistributing the content or generated reports without written authorization
  • Interfering with service availability (DoS, exploits, malware)
No AI training / automated scraping. Extracting, copying, or using Platform content (Trust Scores, profiles, reviews, documents, methodology) to train, fine-tune, evaluate, or benchmark artificial intelligence systems, language models, embeddings, or derivative products is expressly prohibited without an express written commercial license from Shield My Field. This restriction applies to registered users and third parties alike (including bots, crawlers, and agents). Any collector's User-Agent header must identify the responsible entity; we reserve the right to block, take action, and seek damages for infringement.

Breach may result in suspension, account cancellation, and, where applicable, legal action.

9. Intellectual Property

The methodology, trademarks (including "Shield My Field" and "Trust Score"), design, software, compiled database, dashboards, and interfaces are owned by Shield My Field or used under valid license. Pro-plan due diligence reports are licensed for internal use by the subscriber; commercial redistribution is prohibited.

Content sourced from official public sources retains its public nature. User reviews and comments remain property of their authors subject to the license in section 6.1.

10. IP and Privacy Notices

If you believe any content on the Platform infringes intellectual property rights or personality rights (privacy, image, honor), send notice to legal@shieldmyfield.com including: rights holder identification, description of infringing content, specific URL, ownership documentation, and a sworn statement. We will handle the notice under Mexico's Federal Copyright Law and other applicable legislation.

11. Service Availability

We make reasonable efforts to keep the Platform available 24/7, but do not guarantee uninterrupted or error-free availability. We may interrupt the service for scheduled maintenance, updates, security situations, or force majeure. We will notify when reasonably possible.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Shield My Field, its officers, employees, shareholders, and partners are not liable for:

  • Indirect damages, lost profits, lost opportunity, or moral damages
  • Purchase or investment decisions made based on Platform information
  • Inaccuracies in data from official public sources
  • Content posted by third parties (users, developers, media)
  • Breaches of contracts between the user and developers
  • Vulnerabilities attributable to third-party processors (Stripe, Supabase, Vercel) beyond our reasonable selection and supervision duties

Shield My Field's total cumulative liability to the user for any service-related claim is limited to the amount paid by the user in the 12 months preceding the event giving rise to the claim. This limitation does not apply to liabilities that by law cannot be waived (willful misconduct, fraud, harm to life or bodily integrity).

13. Indemnification

The user agrees to indemnify and hold harmless Shield My Field, its officers, employees, and partners against any claim, demand, expense, or loss (including reasonable legal fees) arising from: (i) their posted content, (ii) their use of the Platform in violation of these Terms, (iii) violation of third-party rights, (iv) user fraud or willful misconduct.

14. Force Majeure

Neither party will be liable for breach caused by events beyond its reasonable control, including natural disasters, pandemics, government acts, interruptions of critical infrastructure (power, telecom), large-scale cyberattacks, war, terrorism, or labor disputes. The affected party will notify the other promptly, and both will cooperate to minimize impact.

15. Changes to the Service and Terms

We may modify features, plans, or these Terms. Substantial changes affecting user rights will be notified by email at least 15 calendar days in advance; continued use thereafter implies acceptance. If you disagree, you may cancel the account before the changes take effect.

16. Personal Data and Privacy

Processing of personal data is governed by the Privacy Notice, which forms an integral part of these Terms.

17. Assignment and Severability

The user may not assign these Terms without our prior written consent. Shield My Field may assign its rights and obligations to a successor or affiliate, notifying the user. If any clause is declared null, invalid, or unenforceable, the remaining clauses will remain in force.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of Mexico. For any dispute, the parties submit to the competent courts of Mérida, Yucatán, expressly waiving any other venue, except the consumer's right to submit disputes to the courts or authorities of their domicile under LFPC and conciliation proceedings before PROFECO.

19. Dispute Resolution and PROFECO

Before commencing litigation, the parties will attempt to resolve the dispute in good faith via direct communication for at least 30 calendar days. Consumer users may go to PROFECO for conciliation proceedings: gob.mx/profeco.
